1 Acceptance of Terms

By accessing or using the ApexClub platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated as an individual project and is provided "as is" for entertainment purposes only.

2 Description of Service

ApexClub is a free entertainment service that allows users to:

• Make predictions on Formula 1 race outcomes
• Participate in prediction leagues with other users
• Track their prediction accuracy through a points-based scoring system

The Service uses publicly available Formula 1 race information. This Service is not affiliated with, endorsed by, or connected to Formula 1, FIA, or any Formula 1 teams or drivers.

3 User Accounts

3.1 Registration

• You may register using an email and password or through Google OAuth
• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Security

You must notify us immediately at [email protected] of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Account Deletion

• You may delete your account at any time through your account settings
• Upon deletion, your personal data will be anonymized to preserve league history
• Anonymized data includes your predictions and scores but removes identifying information (email, display name)

4 User Conduct

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use automated systems (bots, scripts, scrapers) to access or interact with the Service
• Create multiple accounts to gain unfair advantages
• Use the Service to harass, abuse, or harm other users
• Create leagues or use display names that are offensive, discriminatory, or violate others' rights
• Attempt to gain unauthorized access to any part of the Service, other user accounts, or computer systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service for any commercial purposes without express permission

4.2 Content Standards

User-generated content (league names, display names) must:

• Not be offensive, abusive, defamatory, or discriminatory
• Not infringe on intellectual property rights of others
• Not contain personal information of others without their consent
• Comply with all applicable laws and regulations

4.3 Enforcement

We reserve the right to remove or modify any user-generated content that violates these Terms, suspend or terminate accounts that violate these Terms, and report illegal activities to appropriate authorities.

5 Leagues

5.1 League Creation

• Users may create up to 2 leagues per account
• Leagues can be public (anyone can join) or private (invite-only)
• League creators have administrative rights to manage their leagues
• Creating and operating public leagues is a permitted and expected use of the Service

5.2 League Administration

League creators may remove members from their leagues, delete their leagues at any time, and control league settings. Good-faith league administration actions (such as removing disruptive members, deleting inactive leagues, or choosing league names) are permitted uses of the Service and will not constitute a violation of these Terms or trigger any indemnification obligation.

5.3 League Participation

• Users join leagues voluntarily
• Points are calculated from the time of joining the league
• We are not responsible for disputes between league members

5.4 Disputes and Restrictions

The operator is not a party to disputes between league members. Any disagreements regarding league administration, membership, or results are between the users involved.

No real-money transactions, wagers, or gambling of any kind are permitted within leagues or anywhere on the Service. ApexClub is a free prediction game for entertainment only.

6 Predictions and Scoring

6.1 Prediction Deadlines

• All predictions must be submitted before the specified deadline for each race
• Deadlines are displayed in UTC and converted to your local timezone
• Late predictions will not be accepted and predictions cannot be modified after the deadline

6.2 Scoring

• Points are calculated based on the accuracy of predictions according to published scoring rules
• We reserve the right to recalculate scores if race results change (e.g., post-race penalties)
• Score calculations are final and not subject to appeal

6.3 Race Results

Race results are entered manually or via automated sources. We strive for accuracy but are not responsible for errors in result entry. Corrections will be made if errors are identified and brought to our attention.

7 Intellectual Property

7.1 Service Content

The Service and its original content (excluding user-generated content) are owned by the operator and are protected by copyright, trademark, and other laws.

7.2 User Content

You retain all rights to content you create (league names, display names). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and store your content as necessary to operate the Service.

7.3 Third-Party Trademarks

Formula 1, F1, team names, driver names, and related marks are trademarks of their respective owners. Their use is for descriptive purposes only and does not imply any affiliation or endorsement.

8 Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our Privacy Policy.

11 Modifications to Service and Terms

11.1 Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice, including changes to features or functionality.

Scoring rule changes: Material changes to scoring rules (meaning any change that would alter a user's existing points by more than 5%) require at least 14 days advance notice via email. Material scoring changes will not be applied retroactively to races that have already been scored in the current season.

11.2 Terms Modifications

We may modify these Terms at any time. We will notify users of material changes via email or Service notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12 Termination

12.1 By You

You may stop using the Service and delete your account at any time.

12.2 By Us

We may terminate or suspend your access in the following circumstances:

• Immediate termination (without prior notice) for: illegal activity, credible security threats to the Service or other users, or violations of GDPR or other data protection laws
• Standard termination (with at least 7 days written notice via email) for: violation of these Terms or other reasons at our discretion

12.3 Appeal

If your account is terminated, you may contest the decision by emailing [email protected] within 14 days. We will review your appeal and respond within 30 days.

12.4 Effect of Termination

Upon termination, your right to use the Service ceases. Before your personal data is anonymized, you will have a 30-day window to request a data export of your predictions, scores, and league memberships. After this window, your data will be anonymized as described in our Privacy Policy.

13 Indemnification

You agree to indemnify and hold harmless the Service operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising directly from:

• Your willful misconduct or illegal activity while using the Service
• Your deliberate violation of these Terms

This indemnification obligation does not apply to:

• Claims arising from normal, good-faith use of the Service, including league administration actions such as creating leagues, removing members, or naming leagues
• Claims where the operator's own negligence or fault materially contributed to the loss
• Any matter covered by your rights as an EU consumer under applicable law

Your total indemnification obligation under this section shall not exceed €100 (one hundred euros), consistent with the liability cap in §10.

14 Dispute Resolution

14.1 Governing Law

These Terms shall be governed by the laws of the European Union and the Netherlands, without regard to conflict of law provisions. As an EU consumer, you retain all rights under applicable EU consumer protection law regardless of these Terms.

14.2 Informal Resolution

For any disputes, please first contact us at [email protected] to seek an informal resolution. We will attempt to resolve any dispute informally within 14 days before either party pursues any formal escalation.

14.3 GDPR Disputes

For disputes related to your personal data or privacy rights, you may also contact the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) at autoriteitpersoonsgegevens.nl.

14.4 Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts in the Netherlands.

15 Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service operator. If any provision is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be considered a waiver. You may not assign or transfer these Terms without our consent.
